Your Committee on Planning, to which was referred Bill No . 636,
regarding the rezoning request of Richard R. Treadwell , et al ,
Lalamilo , South Kohala , Hawaii , TMK: 6-6-02: 3 , 4 , 5 & 6 , reports as
follows:
Bill No . 636 amends Section 25-95F, Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
approximately 1 . 89 acres of land from Open (0) to Single Family
Residential (RS-20) .
The subject properties are located at Wailea Bay . Exhibit A of the
bill shows only two parcels . Parcel No . 1 , measuring approximately
1 . 37 acres , actually consists of three lots of about . 45 acres each .
They were consolidated into one parcel for tax billing purpose .
According to the applicant , "The basic purpose of this request is to
enable each of the three parties to have possession of their
respective properties with a residential zoning designation . Such a
designation would allow them to build their private or personal
residence . The existing Open zoning prohibits such structures and
uses . "
According to the Planning Department , the Hapuna Beach State Park
Plan designates the area for picnic use . The transmittal letter from
the Planning Commission states that , "Finally, while the State
Department of Land and Natural Resources has stated that it is
interested in acquiring the subject properties , we feel that the
rezoning process should not be used to negotiate the value of a
property and acquisition cost . "
The letter from the Planning Commission states that "Since the
applicants do not intend to subdivide the property , no roadway and/or
water improvements are required . Furthermore , based on the requested
RS-20 zoning density , no further subdivision of the lots can occur . "
The General Plan designates the properties for Low Density Urban
Development . The State Land Use district classification is Urban .
