Chairman and Members Hawaii County Council Hilo , Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 588 , regarding a request to delete Condition D of Ordinance No . 86-135 (Keith Tom ) , reports as follows : The purpose of Bill 588 is to amend Section 25-87, Article 3 , Chapter 25 of the Hawaii County Code , relating to the deletion of Condition D of Ordinance No . 86-135 , which reclassified certain lands from Agricultural (A-20a ) to Agricultural (A-la ) at Kalaoa, North Kona , identified as Tax Map Key 7-3-04 : 4. Condition D requires the applicant to widen the pavement and stabilize the shoulders of the Old Government Mauka Road fronting the subject property . Bill 588 was first heard by the Planning Committee on July 11 , 1988 . The Committee 's recommendation to the Council was that the file on Bill 588 be closed . However , the Council opted to recommit the bill for further study . Your Committee again heard the bill on August 16 , 1988, at which time Councilman Sherwood Greenwell circulated snapshots of properties in the vicinity of the subject property, illustrating that individuals are building houses without being required to improve the Old Government Mauka Road . Councilman Greenwell therefore recommended that Condition D be deleted . Rather than act on Councilman Greenwell 's recommendation, your Committee deferred action on the bill , pending a report and recommendation from the Department of Public Works . Bill 588 was again heard by your Committee on September 26, 1988 . A report from the Department of Public Works was forwarded to Committee Chairman Takashi Domingo earlier and is identified as Communication No . 795 . 2. The department 's conclusion is that "The existing road is not adequate for use by additional lots . " A representative of the Department of Public Works gave a summary of Communication 795 . 2 and also shared with Committee members a large site map illustrating the roadway , the subject property and surrounding properties . PC REPORT NO , 375 ADOPTED : OCT 5 1968 r � PC- 375 Page 2 September 26 , 1988 Councilman Greenwell again recommended that Condition D be deleted because other home builders are not being required to improve the existing roadway. Councilman Russell Kokubun stated that he agrees with the Department of Public Works that the roadway should be repaired and that if Condition D is deleted, the Council will find it very difficult to require future rezoning applicants to improve the subject roadway.
