Your Committee on Planning, to which was referred Bill No . 608,
regarding the rezoning request of Huehue Ranch , Kukio, North Kona ,
Hawaii , TMK: 7-2-04 :5 (portion ) and 16 , reports as follows :
Bill No . 608 amends Section 25-86, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 332 acres of land from Open (0) to Resort-Hotel
(V-1 & V-2) ; Village Commercial ( CV-10 ) ; Neighborhood Commercial
(CN-10) ; Single Family Residential (RS-10) (RS-15) & (RS-20) &
Multiple Family Residential (RM-3) (RM-3. 5 ) , (RM-4) & (RM-5) .
The project site is divided into two parcels . One parcel is located
makai of Queen Kaahumanu Highway and encompasses a land area of
approximately 317 acres . The other parcel is located mauka of the
highway and contains approximately 358 acres .
Development of the makai parcel will include an 800-room first class
p
hotel and a 450-room luxury hotel . The resort will be supported by
720 multi-family units , 90 single-family lots , an 18-hole golf
course/clubhouse , a resort commercial center , a private beach
clubhouse and a pond preserve .
The mauka parcel will include approximately 590 multi-family units
and 220 residential lots clustered around another 18-hole golf
course . Other improvements will include a neighborhood commercial
center and a community park .
Bill 608 passed first reading of the County Council on September 7 ,
1988 and was recommitted to the Planning Committee for further
discussion .
Councilman Russell Kokubun informed the Committee that Draft 2 of
Bill No . 608 , which was distributed to each member , amends the
original bill by including several development conditions which are
included in the applicant 's Shoreline Management Area Use Permit but
not in Bill 608 . He also informed the Committee that , as agreed to
during discussion of rezoning Bill 607 , he is agreeable to deferring
action on Draft 2 until such time as other committee members have had
the opportunity to include their amendments .

Committee Vice Chairman Spencer Kalani Schutte stated that he will be
proposing amendments to the bill relating to conditions requiring the
applicant to build a specific number of affordable housing units .
Your Committee heard the applicant 's attorney explain the contents of
Communication No . 1739 . 2, which contains the applicant ' s proposal for
amending Condition B of the bill .
In essence , the applicant is requesting that Condition B be amended
to follow the intent of Council Resolution No . 698-83 and the wording
that is being used for another rezoning application that recently
received Planning Commission approval .
The applicant 's contention is that the present wording of Condition B
places the final determination of this rezoning action in the hands
of the administration rather than the Council . The applicant states
that Condition B empowers the Planning Department and the Department
of Water Supply to make the final determination on whether the
rezoning should take effect .
Communication No . 1739 . 2, along with Communication 1739.1 , a letter
dated August 23, 1988 , from the Planning Director to the applicant 's
attorney, are being forwarded to the Council for information.
Your Committee on Planning is forwarding Bill 608 to the Council for
second and final reading. Your Committee agrees that amendments to
the bill shall be proposed on the Council floor .
