Your Committee on Planning, to which was referred Bill No . 607,
regarding the rezoning request of Kaupulehu Developments , Kaupulehu ,
North Kona, Hawaii , TMK: 7-2-03 :Portion of parcel 1 , reports as
follows:
Bill No . 607 amends Section 25-86, Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
233 acres of land from Open (0) to Multiple Family Residential
(RM-3 & RM-10) , Village Commercial (CV-10 ) and Resort-Hotel (V-2. 25 &
V-10 ) .
The applicant leases approximately 11 ,000 acres of land in the
ahupuaa of Kaupulehu from the Kamehameha Schools/B. P. Bishop
Estate . The applicant plans to develop portions of the lands makai
of the Queen Kaahumanu Highway as a self-contained resort/residential
community to be known as Kaupulehu Resort .
The proposed development concept features two oceanfront hotel
complexes , a beach club , multi-family residential units , two golf
courses and related resort/residential amenities .
Bill 607 passed first reading of the County Council on September 7 ,
1988 and was recommitted to the Planning Committee for further
discussion .
Councilman Russell Kokubun distributed to members of the Committee
copies of Draft 2 of Bill 607 , which amends the original bill by
including several development conditions which are included in the
applicant 's Shoreline Management Area Use Permit but not in Bill 607 .
Committee Vice Chairman Spencer Kalani Schutte requested that action
on Draft 2 be deferred because he will be recommending additional
amendments to the bill , applicable to affordable housing
requirements . He suggested that it would be more appropriate if
Draft 2 contained his and other committee members ' amendments .
Councilman Kokubun stated that he would not be opposed to
Councilman Schutte ' s suggestion if it is understood that Draft 2 will
include all of his amendments to the bill .
Your Committee heard a lengthy explanation from representatives of
the Planning Department and the Office of Housing and Community
Development as to how the administration arrived at the number of
affordable housing units the applicant is being required to build .

Your Committee expressed its concern that the affordable housing
requirements were being assessed on both resort and residential
components of the proposed development . Your Committee was also
apprised by the Housing Agency staff that different formulas were
used to determine the maximum limits for the respective components .
Your Committee also heard that these maximum limits did not
necessarily mean that the developer would be faced with the full
burden of the assessments ; federal and state programs could be used
to achieve the affordable housing assessment numbers .
The Planning Director emphasized that affordable housing assessments
were being imposed upon primary employment centers . This procedure
was in consonance with the General Plan. The housing problem was
recognized by the General Plan since its inception 18 years ago .
Your Committee was assured that the administration had no intentions
of interfering with the Council ' s policy formulation function . The
60 percent affordable housing requirement is their recommendation
only and is subject to Council ' s review and amendment .
Councilwoman Lorraine Jitchaku-Inouye expressed concern that the
market may not be large enough to justify the number of affordable
housing units that the applicant and other large developers are being
required to build . She was assured by the Planning Director that the
applicant will not be required to build more units than the market
will bear .
Your Committee on Planning is forwarding Bill 607 to the Council for
second and final reading . Your Committee agreed that amendments to
the bill shall be proposed on the Council floor . Communication
No . 1773, a memo from the Planning Director to the Council Members ,
dated September 7 , 1988 , is being forwarded to the Council for
information.
