Your Committee on Planning, to which was referred Bill No. 615,
regarding the rezoning request of Kailua Bay Village, Inc. ,
Kailua- Kona, Hawaii , TMK : 7-5- 09 :portion of parcel 25, reports as
follows:
Bill No. 615 amends Section 2589, Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
2 . 25 acres of land from Multiple Family Residential (RMO1 ) to
Resort-Hotel (V. 75) .
A portion of the subject property is already zoned for Resort use.
Therefore, the rezoning request applies to the remaining area .
The proposed development will consist of eight free standing
structures . Five of these structures will be one-story and the
remaining three will be two-story in height . Tenants will be
primarily specialty retail shops and restaurants . The development
will include at least 283 parking stalls . An onsite sewage
treatment plant will be constructed if the Department of Public
Works ® Wastewater & Solid Waste Division determines that it is not
possible for the subject development to hook into the County ' s system.
Although retail and restaurant operations are more reflective of
commercial than resort uses, the Planning Director has determined
that the project is "necessary to the proper functioning of the
Kailua Village Major Resort destination area . "
In response to Councilman Russell Kokubun' s inquiry as to why curbs,
gutters and sidewalks are not being required , as recommended by the
Department of Public Works, the applicant ' s representative stated
that instead of curbs, gutters and sidewalks , the applicant is being
required to construct pedestrian ways along portions of Kuakini
Highway and Alii Drive, subject to the approval of the Chief
Engineer . The applicant ' s representative added that the Planning
Department and Planning Commission agreed that the contour of the
subject property makes the installation of curbs, gutters and
sidewalks unfeasible.
Council Chairman Stephen Yamashiro asked Planning Director
Albert Lyman whether the applicant is being required to meet minimum
housing requirements. Mr. Lyman answered in the negative.

Chairman Yamashiro then inquired as to why the Planning Department is
not considering the housing impact that the proposed project may
generate. Mr . Lyman stated that the primary reason is that the
project will be creating secondary jobs as opposed to primary jobs .
Chairman Yamashiro asked Mr . Lyman whether the department ' s housing
policy will hereafter be distinguishing primary from secondary job
generators. Mr . Lyman stated that the General Plan already makes
such a distinction.
Acting Committee Chairman Kalani Schutte informed Mr . Lyman and
Mr . Scott Leithead, Administrator of the Office of Housing and
Community Development, that the Council will not assess housing
requirements on certain projects and not on others . Acting Chairman
Schutte asked Mr . Leithead to review this project and to report to
the Committee on how, if any, housing requirements will be imposed .
After further discussion, Council Chairman Yamashiro suggested that
the bill be forwarded to the Council for first reading.
Acting Chairman Schutte stated that the motion on the floor is to
pass Bill 615 out of Committee to the Council and that the Planning
Department and Housing Agency be instructed to present to the Council
a proposed policy on affordable housing.
Council Chairman Yamashiro instructed Mr . Lyman and Mr . Leithead to
work together , develop and present to the Planning Committee a
proposed housing policy. In answer to
Councilman Sherwood Greenwell ' s inquiry, Chairman Yamashiro stated
that he wanted the proposal immediately.
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 615 and recommends that it pass first reading .
