Your Committee on Planning, to which was referred Bill No . 581,
regarding the County General Plan and General Plan Land Use Pattern
Allocation Guide Map amendment request of Palace Development
Corp./Hawaii Ka 'u Aina Partnership, Kahuku, Ka 'u, Hawaii , reports as
follows:
Bill No . 581 amends the County of Hawaii General Plan, as originally
adopted by Ordinance No . 439 and as amended by Ordinance Nos . 456 ,
475 , 484 , 539 , 822, 851, 854 , 868 , 878, 83-20, 83-27, 84-40 , 87-49,
87-52, 87-68 and 87-128 .
The bill redesignates approximately 3, 244 acres of land, identified
as TMK : 9-2-01 : 72, 75 & 76 , from Conservation and Extensive
Agricultural to Resort, Medium Density and Low Density Urban,
Industrial and Open. The General Plan Land Use element is also
amended to include Kahuku as a Major Resort area.
The bill passed first reading of the County Council at its meeting of
July 6 , 1988 .
During the July 6 Council meeting, Councilman Russell Kokubun raised
concerns about the phrasing of Condition (E) of the bill which
implies that the developers are being required to develop a source of
potable water and transmission infrastructure prior to receiving
rezoning approval.
Council Chairman Stephen Yamashiro raised concerns about Conditions
(N) and (0) which state that the applicants will be required to
improve Mamalahoa Highway as may be required by the State Department
of Transportation .
Chairman Yamashiro also questioned the need to include any reference
to Shoreline Management Area Use Permits in the bill since the
Council has no jurisdiction in this area .
Corporation Counsel John Wagner stated that he will meet with the
Planning Director to discuss the concerns expressed by the Council .
The bill was recommitted for further study .

At its July 25, 1988 meeting, your Committee heard several
individuals testify in support of the bill . Your Committee also
approved proposed amendments to the bill which were distributed to
Committee members.
Condition (E) has been amended to read as follows: [Develop]
Demonstrate at the time of rezoning that all of the necessary water
source and transmission infrastructure to provide an adequate supply
of potable and non-potable water can be developed for the proposed
project ;
Condition (M) has been amended to read as follows : "Provide public
access and related improvements to and along the coastline, and
submit a public access plan as part of an application for rezoning
[and Special Management Area Use permits] ; "
Condition (N) has been amended to read as follows: "Work with the
State Department of Transportation to monitor traffic conditions and
[participate] to determine Petitioner ' s participation in roadway
improvements to the Mamalahoa Highway [as required by the State
Department of Transportation] ; "
Conditions (B) , (C) , (F) , (G) , ( I) , (J) , (K) , (L) and (M) have been
amended to delete all references to Special Management Area Use
Permits .
Your Committee on Planning is in accord with the intent and purpose
of Bill 581, Draft 3, and recommends that it pass second and final
reading.
Note: Underscoring and brackets are used in this committee report
only and does not appear in Draft 3 of Bill 581 .
