Your Committee on Planning, to which was referred Bill No . 571,
regarding the State Land Use Boundary amendment request of
Cecelia Luiz , Kaapoko Homestead, South Hilo, Hawaii ,
TMK: 2-7-04 :Portion of 96 , reports as follows:
Bill No . 571 amends the State Land Use Boundaries Map, H-65 , of the
County of Hawaii , by changing the district classification of
1 .065 acres of land from Agricultural to Urban .
According to the Planning Commission, "Currently, .562 acre of the
property is within the Urban District ; therefore , the purpose of this
request is to reclassify the remaining 1 .06-acre into the Urban
District . It should be noted that the entire 1 .6-acre was previously
classified Urban by the State Land Use Commission . However , since
the 1 .06-acre area , which was previously a portion of a larger lot,
was in sugar cane production, the former landowner petitioned the
State to revert the land back into the Agricultural District . The
affected area is no longer used for the growing of sugar cane . "
The' property is zoned Single Family Residential - 10 ,000 square foot
(RS-10 ) .
The applicant plans to subdivide the property into four lots and
distribute the lots to her grandchildren .
The bill passed first reading of the Council on June 15 , 1988 and was
recommitted at the recommendation of Committee Chairman Takashi
Domingo who stated that the bill will have to be amended to include
development conditions which were inadvertently omitted .
The bill was first heard by your Committee on June 6 , 1988 and was
forwarded to the Council without development conditions , after the
Planning Director assured Councilman Russell Kokubun that conditions
were not necessary in this situation in spite of strong
recommendations , to the contrary, from the Public Works and Police
Departments .
Bill 571, Draft 2 , was heard by your Committee at its July 11 , 1988
meeting . Draft 2 contained several development conditions which were
recommended by the Planning Department .

At its July 11 meeting, your Committee heard testimony from the
applicant 's planning consultant who requested that Condition D of the
bill be amended because the condition requires the applicant to
improve the entire Kaapoko Homestead Road. Condition D reads as
follows:
"prior to receipt of final subdivision approval,
provisions to improve Kaapoko Homestead Road, including
the right-of-way abutting the subject property, shall
be approved by the Department of Public Works ; "
The applicant' s consultant requested that the condition be amended by
deleting the words "Kaapoko Homestead Road , including . " Deletion of
these words will require the applicant merely improve the
right-of-way abutting the subject property .
Your Committee agreed with the applicant's consultant and has
therefore amended the bill accordingly .
Your Committee on Planning is now in accord with the intent and
purpose of Bill No . 571 , Draft 3 , and recommends that it pass second
and final reading.
