Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 589 , regarding the rezoning request of C. Brewer Properties, Inc . , Ninole , Wailau and Punaluu , Kau, Hawaii , TMK: 9-5-19 : 11 , 15 , 26, 33 & 35 and TMK : 9-6-02 : 8 , 37 , 38 , 41 & 45 , reports as follows: Bill No . 589 amends Section 25-109, Article 3 , Chapter 25 of the Hawaii County Code , by changing the district classification of approximately 174 acres of land from Village Commercial - ( CV-10 ) , Multiple Residential - (RM-2) , Resort Hotel - (V-1 .5 ) , Single Family Residential - (RS-20 & RS-7 .5 ) , Open - (0) , and Agricultural - (A-20a ) to Multiple Residential - (RM-2, RM-2 .5 & RM-3 ) , Village Commercial - ( CV-10 ) , Resort Hotel - (V-1 .5 ) and Open (0) . The Planning Director and Planning Commission are recommending that the rezoning request be approved. In its transmittal letter , the Planning Commission states that zone changes are necessary because the applicant is requesting revisions and adjustments to its original master plan of the area . The Commission further states that . "The areas requested to be rezoned , as well as to be reconfigured, will be integrated as part of the existing development . It is felt that the requested zone changes contemplated will be in the direction of creating a self-contained resort destination at this section of the Ka 'u District . " Your Committee, at its July 11 , 1988 meeting, heard testimonies from approximately 52 individuals . Of these 52 individuals , approximately 36 spoke in favor of the rezoning bill and 16 spoke in opposition . A couple of speakers inferred that C. Brewer Properties, Inc . does not have clear title to the subject parcels included in the rezoning bill . One of the speakers shared with Committee members a document which she claims proves that she is the rightful owner of a small parcel of land located within the proposed development . Councilman Frank De Luz stated that conflict involving land ownership should have no bearing on the rezoning application. He stated that this conflict is a legal matter which should be settled in court . PC REPORT No . 351 ADOPTED : JUL 2 0 19 411 111 PC- 351 Page 2 July 11 , 1988 In response to Councilman Russell Kokubun' s inquiry, the applicant 's representatives stated that the parcel in question is not included in the rezoning bill . Councilman Kokubun inquired as to whether or not the applicant is aware of the fact that the proposed resort is located just outside of the proposed Palima Point satellite launching facilities ' "Caution Corridor" as described by Arthur D. Little ' s "Selection of a Location for a Space Launch Facility in Hawaii" dated April 1988 . The applicant ' s representatives answered in the affirmative . In response to Councilman Kokubun' s inquiry, the applicant ' s representative stated that they will restore the ponds located along the shoreline . Councilman Kokubun stated that he wanted the applicant 's acknowledgement of this plan for the record . In response to Councilman Kokubun ' s inquiry, the applicant ' s representatives stated that they would have no objection to amending the bill to include conditions regarding shoreline access as stated in their rezoning application . Councilman Kokubun stated that he realizes that provisions for shoreline access will be discussed during the Shoreline Management Area (SMA) permit review; however , he would prefer to include this condition in the bill since the Council is not involved in the SMA review.
