Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 581 , regarding the County General Plan and General Plan Land Use Pattern Allocation Guide Map amendment request of Palace Development Corp. /Hawaii Ka 'u Aina Partnership, Kahuku, Ka 'u, Hawaii , reports as follows: Bill No . 581 amends the County of Hawaii General Plan, as originally adopted by Ordinance No. 439 and as amended by Ordinance Nos . 456 , 475 , 484 , 539 , 822, 851 , 854 , 868 , 878 , 83-20 , 83-27, 84-40 , 87-49, 87-52, 87-68 and 87-128 . The bill redesignates approximately 3 , 244 acres of land, identified as TMK: 9-2-01: 72, 75 & 76 , from Conservation and Extensive Agricultural to Resort, Medium Density and Low Density Urban, Industrial and Open. The General Plan Land Use element is also amended to include Kahuku as a Major Resort area . Your Committee heard testimonies from approximately 20 speakers speak in support of the bill . Councilman Russell Kokubun inquired of the Planning Director as to the kinds of permits that the developer will be required to secure prior to commencing construction of the proposed marina . The Planning Director stated that the developer will be required to secure several different permits from various County, State and Federal agencies . Examples of permits which will be required are Special Management Area (SMA) permits , grading permits and permits from the Department of Health and Army Corps of Engineers . Councilman Kokubun questioned the applicant ' s planning consultant as to whether he is aware of the fact that the proposed project is located in Zone 2 , which is defined by the project ' s Environmental Impact Statement as "several areas that are adjacent to and downslope from the active rift zones of Kilauea and Mauna Loa and therefore subject to burial by lava flows of even small volume erupted in those rift zones --- On Mauna Loa , long and voluminous lava flows have repeatedly entered the areas included in Zone 2, covering about 5 percent of those areas since 1950 and about 20 percent within historical time (USGS, 1987) . " The applicant 's consultant informed Councilman Kokubun that he is aware of the fact that the proposed project is located in Zone 2 . PC REPORT No . 34• ADOPTED : L 6 19 r- S 411 PC- 349 Page 2 June 20 , 1988 Councilman Kokubun informed the applicant's representative that while he applauds the applicant 's offer to provide sites within the subject property for public facilities such as police , fire and schools , he inquired as to whether the applicant would be receptive to amending Condition D by inserting the word "useable" before sites . The applicant ' s representative answered in the affirmative . Therefore , your Committee has amended Condition D to read as follows: " (D) Provide useable sites within the subject property for the County and/or State for [ such] public facilities such as police , fire , solid waste transfer , schools , andmedical services; " Councilman Kokubun explained that the reason for recommending this amendment is that he is aware of a development which also had land set aside to accommodate public facilities; however , the area which was set aside contained fallen lava tubes and other topographical features which rendered the land unuseable . The applicant' s representative stated that they are in contact with various agencies regarding this situation and assured the Committee that they will be providing useable land. Your Committee on Planning is in accord with the intent and purpose of Bill 581, Draft 2, and recommends that it pass first reading.
