Your Committee on Planning, to which was referred Bill No . 579 ,
regarding a request to amend Condition D of Ordinance No . 86-92
(TSA International ) , reports as follows:
The purpose of Bill 579 is to amend Section 25-87 , Article 3 ,
Chapter 25 of the Hawaii County Code , relating to the modification of
conditions to Ordinance No . 83-38 and further amended by Ordinance
No . 86-92 , which reclassified certain lands from Open (0) to Limited
Industrial (ML-la ) at Kaloko, North Kona , identified as
TMK: 7-3-51: 1 (Portion ) , 2-59 ( Formerly 7-3-09 :Portion of 1 ) .
Condition D of Ordinance 86-92 states , in part , "Said plan shall
reflect the proposed berming and landscaping depicted on Figure 17 of
the petitioner 's Final Environmental Impact Statement dated July 1981
and a program for its maintenance . These improvements shall be
provided prior to the granting of final subdivision approval of the
first increment . "
Final subdivision approval was issued for the first increment in
April 1984. Construction plans were approved earlier without the
berm required by Condition D.
The overall master landscaping plan was submitted to the
Planning Department on April 18 , 1984 , after final Subdivision
Approval was issued to the petitioner .
The applicant is requesting that Condition D be amended by deleting
the following wording, "Said plan shall reflect the proposed berming
and landscaping depicted on Figure 17 of the petitioner 's Final
Environmental Impact Statement dated July 1981 and a program for its
maintenance , " and replacing it with the following: "Said plan shall
include a program for maintenance of the landscaping along
Queen Kaahumanu Highway fronting the Kaloko Light Industrial Park . "
According to the Planning Commission, "The berm which was originally
required along the frontage of this industrial subdivision cannot be
reasonably built with the present developed state of the site .
Therefore, an alternative needs to be developed and implemented . "

As such , the Commission is recommending that Condition D of
Ordinance 86-92 be deleted in its entirety and replaced with the
following:
"The conceptual landscaping plan dated July 23, 1986
which depicts the buffer parcel landscaping and on-site
landscaping strips shall be used as a guide with the
Development Design Manual for evaluating all
development through the Plan Approval process to
implement the industrial park theme . A "detailed"
landscaping plan for the buffer parcel shall be
submitted for Plan Approval within one month from the
effective date of approval of this amendment . This
detailed landscaping plan shall show the planting
schedules , tree sizes , heights (actual size of trees to
be planted) , type of irrigation system, etc . All
approved landscaping improvements shall be installed
within three months from the date of final plan
approval of the detailed landscaping plan issued by the
Planning Director . A Landscape Maintenance Program for
the landscape buffer parcel shall be submitted with the
submittal of the detailed landscaping plan for Plan
Approval; "
Your Committee on Planning is in accord with the intent and purpose
of Bill 579 and recommends that it pass first reading .
