Your Committee on Planning, to which was referred Bill No . 556 ,
regarding the rezoning request of Taiyo Hawaii Co . , Ltd . , Auhaukeae ,
North Kona, Hawaii , TMK : 7-5-10 :8 & 57 , reports as follows :
Bill No . 556 amends Section 25-87 , Article 3, Chapter 25 of the
Hawaii County Code, relating to the modification of property
descriptions to Ordinance No . 87 129, County of Hawaii , which
reclassified certain land from Unplanned (U) to Multiple Family
Residential (RM-4) , and Neighborhood Commercial ( CN-20 ) .
Bill 556 passed first reading of the County Council on May 18 , 1988
and was recommitted to the Planning Committee at the request of
Committee Chairman Takashi Domingo, for further review.
Theur ose of Bill 556 is to correct the metes and bounds

description of the subject property as stated in Ordinance 87 129 .
The metes and bounds description for portions of the property were
incorrectly stated in the process of drafting a revised rezoning bill
to incorporate amendments initiated by the County Council .
At the May 23 , 1988 meeting of the Planning Committee ,
Councilman Kokubun expressed concern as to who will be responsible
for maintaining the private roads within the proposed development .
In light of these concerns, Councilman Kokubun suggested that the
bill be amended to deal with this problem involving the maintenance
of these roads .
Councilman Kokubun asked Corporation Counsel John Wagner to review
this issue sand to propose appropriate amendments at the next
committee meeting.
At the June 6 , 1988 meeting of the committee, Councilman Kokubun
informed the committee that his concerns regarding maintenance of the
private roads have been resolved. He stated that he recently met
with the attorney for the applicant and was informed that the
applicant is planning to develop the project under the
Horizontal Property Regime . This will require all purchasers of
condo units to join the association, which, in turn, will be
responsible for maintaining the private roads and other common
elements .

Your Committee on Planning is now in accord with the intent and
purpose of Bill No . 556 and recommends that it pass second and final
reading.
