Chairman and Members Hawaii County Council Hilo , Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 503 , Draft 2, regarding the rezoning request of Lillia Krieger , et . al . , North Kona, Hawaii , TMK: 7-9-12 :18 , reports as follows: Bill No . 503 amends Section 25-87 , Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of 7 .099 acres of land from Agricultural (A-5a ) to Residential-Agricultural (RA-la) . While the Planning Commission is recommending approval of the application, the Planning Director is recommending denial because the proposed rezoning violates Section 205-2, Hawaii Revised Statutes , and is inconsistent with the State Land Use Regulations and the General Plan . There are five single family dwellings on the property . The applicant plans to subdivide the property into five lots of approximately one acre each, to accommodate each of the five dwellings . According to the Planning Department, in addition to the five dwellings , a guest house is also located on the property . Of these six structures , only two of the dwelling units have all necessary permits . Current access to the property from Mamalahoa Highway is via a 50-foot road reserve which has an 8- to 10-foot wide pavement with 4-foot wide shoulders . The applicants stated- that they plan to provide a new access to the proposed lots . Bill 503 , Draft 2, passed first reading of the County Council on April 6 , 1988 and was recommitted to the Planning Committee for further review. Councilman Russell Kokubun stated that he had recommended that the bill be recommitted because Condition C fails to require the applicant to construct the extension of Mamao Street to County dedicable standards . Therefore, Councilman Kokubun recommended an amendment to Condition C to read: "Mamao Street shall be extended to the northern boundary of the subject property . Construction of the extension shall be to County dedicable standards . " PC REPORT N0 , --,343 ADOPTED : JUN 15 1988 111 411 PC- 343 Page 2 June 6 , 1988 The applicants ' representative explained to the Committee that the cost of constructing a dedicable road will be prohibitive because there is a deep depression ression in the property which will require the construction of a bridge , if applicant is required to extend Mamao Street through the property, in a straight line . Your Committee voted to defeat Councilman Kokubun ' s proposed amendment to Condition C in favor of the condition as stated in the bill . Your Committee on Planning is now in accord with the intent and purpose of Bill 503, Draft 2, and recommends that it pass second and final reading.
