Your Committee on Planning, to which was referred Bill No . 467,
reports as follows :
Bill 467 amends Chapter 25 of the Hawaii County Code, by adding a new
Downtown Hilo Commercial Zoning District .
The bill amends the County Code by adding a new article to read as
follows : Article 26 , CDH, Downtown Hilo Commercial Zoning District .
The Downtown Hilo Commercial ( CDH) district is established to
reinforce and promote downtown Hilo ' s role as a compact high density
area for retail shopping, professional and administrative activities ,
cultural and arts activities , other supportive business and
commercial services and multi-family housing.
Bill 467 passed first reading of the County Council on January 18 ,
1988 and was recommitted to the Planning Committee for further review
and consideration on the recommendation of Councilwoman Merle Lai .
At a subsequent meeting of the Committee , Councilwoman Lai introduced
an amendment to correct an obvious conflict that existed between
subsections (a ) and (b ) of Section 25-285 of the bill .
Councilwoman Lai 's amendment replaced Section 25-285 (b ) in the
entirety, with a new Downtown Hilo Design Review Commission.
Councilwoman Lai simultaneously introduced Bill 511 to amend the
Hawaii County Code by adding a new Article to create a Downtown Hilo
Design Review Commission . The amendments , as explained in
Communication 1437 . 2, were aimed at : 1 ) correcting the conflict that
existed between subsections (a ) and (b ) of Section 25-285 and
2) establishing a procedure whereby individuals could turn to the
Board of Appeals (rather than to the Circuit Court ) to seek relief
from decisions affecting their plans to develop or renovate
properties in Downtown Hilo .
Further action on the bill was deferred at the request of the
Hawaii Redevelopment Agency ( HRA) . In the interim, your Committee
received Communication 1437 . 4, a letter from Corporation Counsel ,
stating that the provisions in Bill 467 (Draft 2 ) and 511 are in
conflict with Chapter 53 , Hawaii Revised Statutes , and are,
therefore , illegal and void .
Draft 3 of the bill was forwarded to Councilwoman Lai by the HRA on
May 17 , 1988 , via transmittal letter identified as
Communication 1437 .5 .

Draft 3 deletes subsections (b ) to. (f ) , inclusively, of
Section 25-85 , thereby deleting the Downtown Hilo Design Review
Commission and any reference to the establishment of a parking
assessment fee or a special parking fund for Downtown Hilo. It also
enables individuals to turn to the Board of Appeals to seek relief
from decisions affecting their plans to develop properties in
Downtown Hilo.
Your Committee on Planning is now in accord with the intent and
purpose of Bill 467, Draft 3 , and recommends that it pass second and
final reading.
