Your Committee on Planning, to which was referred Bill No . 571,
regarding the State Land Use Boundary amendment request of
Cecelia Luiz , Kaapoko Homestead, South Hilo, Hawaii ,
TMK : 2-7-04 :Portion of 96 , reports as follows :
Bill No . 571 amends the State Land Use Boundaries Map, H-65 , of the
County of Hawaii , by changing the district classification of
1 .065 acres of land from Agricultural to Urban .
According to the Planning Commission, "Currently, .562 acres of the
property is within the Urban District ; therefore, the purpose of this
request is to reclassify the remaining 1 .06 acres into the Urban
District . It should be noted that the entire 1 .6 acres was
previously classified Urban by the State Land Use Commission .
However , since the 1 .06-acre parcel , which was previously a portion
of a larger lot , was in sugar cane production , the former landowner
petitioned the State to revert the land back into the Agricultural
ricultural g
District . The affected area is no longer used for the growing of
sugar cane . "
The property is zoned Single Family Residential - 10 ,000 square foot
(RS-10 ) .
The applicant plans to subdivide the property into four lots and
distribute the lots to her grandchildren .
The Department of Public Works and Police Department have recommended
that the applicant be required to improve a portion of
Kaapoko Homestead Road. Kaapoko Road, which provides access to the
subject property, is maintained by the County but is in substandard
condition .
Councilman Kokubun questioned the Planning Director as to why
Bill 571 fails to contain any development conditions , in spite of the
concerns expressed by both the Department of Public Works and the
Police Department regarding the substandard condition of
Kaapoko Homestead Road . (Kaapoko Road is a County maintained
substandard road . )

The Planning
Director stated that he does not believe that the
situation warrants extensive improvements to Kaapoko Road .
Councilman Kokubun asked the Planning Director if, for the record, he
is stating that it is not necessary to include the conditions
recommended by the Department of Public Works and the
Police Department . The Planning Department answered in the
affirmative .
Water and other essential utilities are available to the property .
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 571 and recommends that it pass first reading.
