Your Committee on Planning, to which was referred Bill No . 563 ,
regarding the rezoning request of Richard Ohrstrom, Kahei ,
North Kohala , Hawaii , TMK : 5-5-01: 112 & 113 , reports as follows:
Bill No . 563 amends Section 25-95B, Article 3 , Chapter 25 of the
Hawaii County Code, by changing the district classification of
9 . 12 acres of land from Agricultural (A-20a ) to Agricultural (A-3a) .
The applicant plans to subdivide the property into two lots of
approximately 4 .9 and 4 .3 acres . There is an existing single family
dwelling on the proposed 4 . 3-acre lot . The applicant states that a
macadamia nut orchard has been established on the other lot .
The Planning Director and Planning Commission are recommending that
the application be denied .
The Planning Commission states that "The primary concern regarding
this particular application is with respect -to the roadway access to
the property. " The Commission states that the access road has a
right-of-way of only 30 feet . The pavement width is only 9 or
10 feet with little or no shoulders . "
The Department of Public Works has recommended that the application
be deferred until such time that the access road is improved because
the road , in its current condition , is unable to safely support
additional traffic .
The Planning Commission states that "The creation of additional lots
along this 'roadway will affect the roadway 's capacity not only by the
action of this proposal , but by other lots situated along this road
potentially seeking rezoning . As a matter of fact , there are two
other pending rezoning applications for properties which will utilize
the same roadway (Monroe Woolard/William Graham and Richard & Carol
Silva) . "
Your Committee agrees that the access road is far too substandard to
be subjected to increased use . Also , approval of Bill 563 may commit
the County Council to approve rezoning requests of owners of
adjoining properties .
