Your Committee on Planning, to which was referred Bill No . 558 ,
reports as follows:
Bill 558 amends Chapter 25 ( Zoning Code ) , Article 1 , Division 7 ,
Section 25-46 of the Hawaii County Code relating to supplementary use
regulations .
In the past, the Planning Department had allowed the establishment of
on-site real estate offices on a temporary basis through the plan
approval process . However , according to the Planning Department,
"-- a review of the Hawaii County Zoning Code found that a temporary
real estate office is not permitted in single-, double- or
multiple-family residential (RS, RD, RM) zoned districts . As a
consequence , several developers in Kona have been asked to terminate
the use . "
Bill 558 will allow the establishment of temporary real estate
offices within new residential subdivisions or developments . The
bill clearly differentiates temporary on-site real estate sales
offices and permanent real estate offices . .
Bill 558 amends the Zoning Code by establishing a new Section 25-46 ,
to be referred to as "Temporary Real Estate Offices and Model Homes . "
Your Committee on Planning is in accord with the intent and purpose
of Bill 558 and recommends that it pass first reading .
