Your Committee .on Planning, to which was referred Bill No . 539 ,
regarding a request to amend Condition H of Change of Zone Ordinance
No . 86 110 , reports as follows :
The purpose of Bill 539 is to amend Section 25 88 , Article 3 ,
Chapter 25 of the Hawaii County Code, relating to the modification df
Condition H of Ordinance 86 110 which reclassified certain lands from
Single Family Residential (RS-10 ) to Village Commercial (CV-7 .5 ) at
Keopuka, South Kona, Hawaii , identified as Tax Map Key 8-1-6 : 44 .
The subject property is the site of Lou ' s Chevron Service, located
along the mauka side of Mamalahoa Highway, Keopuka, South Kona .
Prior to 1985 , the service station was in operation as a
non-conforming use . When it was rezoned from residential to
commercial use in late 1985 , one of the rezoning conditions was
Condition H which restricted the hours of operation from 6 :00 a.m. to
12 :00 p.m.
Wayne Easely, the current owner of the service station, is requesting
that the portion of Condition H, which restricts the hours of
operation , be deleted to permit him to operate the business on a
24-hour basis .
The Planning Director is recommending that the request be denied ;
however , the Planning Commission is recommending approval based on
testimonies received at the public hearing.
