Your Committee. on Planning, to which was referred Bill No . 538 ,
regarding a request to amend Condition E of Ordinance No . 86 131 ,
reports as follows :
The purpose of Bill 538 is to amend Section 25-86 , Article 3 ,
Chapter 25 of the Hawaii County Code, relating to the modification of
Condition E of Ordinance No . 86 131 which reclassified certain lands
from Agricultural (A-20a) to Agricultural (A-3a ) at Kaloko,
North Kona, Hawaii , identified as Tax Map Key 7-3-24 :21 .
The Planning Commission 's transmittal letter infers that the
County Council had recommended that Condition E be deleted .
According to the Planning Department , the reference to "your request"
is in error .
The subject property is located in the Kaloko Mauka Subdivision .
The applicant submitted a rezoning application in December 1985 .
While the Planning Director recommended denial of the request , the
Planning Commission voted to recommend approval . The County Council
approved the request in November 1986 .
In a July 16 , 1987 letter to the Planning Director , the applicants '
attorney stated that it was the applicants ' understanding that
Condition E referred to a drainage master plan for the subject
property and not for the entire Kaloko Mauka Subdivision . The
attorney further stated that in a letter dated April 30 , 1987 , the
Department of Public Works informed the applicant that as per
Condition E, the applicant will be required to perform a hydrologic
study for the entire subdivision .
Bill 538amends Condition E byincludingthe followingrevised
requirement as recommended by the Department of Public Works :
"Petitioner shall install a drainage system which will
dispose of its pro rata share of pre-existing basin
flow and subdivision 's flow due to development , meeting
with the approval of the Department of Public Works .
The pro rata share ratio computation also shall be
reviewed and approved by the Department of Public
Works . "

of Bill 538 and recommends that it pass first reading.
