Your Committee on Planning, to which was referred Bill No . 537 ,
regarding a request to amend Condition E of Ordinance No . 86 83 ,
reports as follows:
The purpose of Bill 537 is to amend Section 25-86 , Article 3 ,
Chapter 25 of the Hawaii County Code , relating to the modification of
Condition E of Ordinance No. 86 83 which reclassified certain lands
from Agricultural (A-20a) to Agricultural (A-3a) at Kaloko,
North Kona, Hawaii , identified as Tax Map Key 7-3-24 :4 .
The Planning Commission 's transmittal letter infers that the
County Council had recommended that Condition E be deleted .
According to the Planning Department , the reference to "your request"
is in error .
The subject property is located in the Kaloko Mauka Subdivision,
Increment I .
The applicant submitted a rezoning application for the subject
property in 1985 . While the Planning Director recommended denial of
the request , the Planning Commission voted to send a favorable
recommendation to the County Council . The Council approved the
change of zone effective August 19 , 1986 .
Condition E mandated the applicant to install a drainage system in
accordance with the requirements of the Department of Public Works .
As such , the Department of Public Works imposed the following
requirement as per Condition E :
"Submit drainage calculations and a comprehensive flood
control master plan for the entire Kaloko Mauka
Subdivision for review and comment . No additional
storm runoff to adjacent properties or roadways due to
this subdivision development will be allowed . No
generated storm flow shall be disposed of within the
subdivision . "

Bill 537 amends Condition E by including the following requirements
as recommended by the Department of Public Works :
"Petitioner shall install a drainage system which will
dispose of its pro rata share of pre-existing basin
flow and subdivision 's flow due to development, meeting
with the approval of the Department of Public Works .
The pro rata share ratio computation also shall be
reviewed and approved by the Department of Public
Works . "
Your Committee on Planning is in accord with the intent and purpose
of Bill 537 and recommends that it pass first reading.
