Your Committee on Planning, to which was referred Bill No . 535 ,
regarding the rezoning request of Mauna Lani Resort, Inc . ,
Anaehoomalu and Waikoloa, South Kohala, Hawaii , TMK : 6-8-22 :Portion
of 13 , 15 , 27 and 37 , reports as follows:
Bill No . 535 amends Section 25-95G, Article 3 , Chapter 25 of the
Hawaii County Code, by proposing the following changes in district
classification:
1 . From Open to Multiple Family Residential ,
approximately 7 .63 acres .
2 . From Multiple Family Residential to Open,
approximately 7 .65 acres .
3 . From Open to Resort-Hotel , approximately 0 .87 acres .
The net result of these changes will be:
1 . Multiple Family Residential will decrease by
0 .25 acres .
2 . Open will decrease by .845 acres .
3. Resort will increase by 0 .87 acres .
The proposed Open and Multiple Family Residential zone changes are
for the purpose of switching the existing 8th golf fairway with the
adjacent vacant multi-family residential site . The additional resort
zoning is intended to accommodate construction of three bungalow
suites , which will be consolidated with the Mauna Lani Bay Hotel
project and operation .
The General Plan designates the area as a Major Resort, which is
defined as a self-contained resort destination area providing basic
and support facilities for the needs of the entire development .
The State Land Use district classification is Urban .

Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees, conditions included herein may, at the
developer ' s election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 535 , Draft 2, and recommends that it pass first reading .
Note : Underscoring is being used in this committee report only and
will not appear in Bill 535 .
