Your Committee on Planning, to which was referred Bill No . 534 ,
regarding the rezoning request of Naoji Kawamata and Amy Hara,
Kohala Estates Subdivision, Kahua, Hawaii , TMK : 5-9-6 :8 & 9 , reports
as follows:
Bill No . 534 amends Section 25-95A, Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of 16 .030
acres of land from Unplanned (U) to Agricultural (A-3a) .
The rezoning application involves two parcels of 7 .2 and 8 .8 acres .
The applicants plan to consolidate and resubdivide the properties
into five lots with each lot measuring at least three acres in size .
The applicants have stated that "The resulting parcels will be
developed agriculturally , houses will be constructed on each parcel
and made available to the public . "
The General Plan designates the property as Extensive Agriculture .
The State Land Use district classification is Agricultural .
Water will be available from- Kohala Ranch Water Company 's private
water system. The water company has committed to provide
3 ,000 gallons of water per day for the proposed subdivision . All
other essential utilties and services are available to the property.
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance :
SECTION 3 . Should the council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees, conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
