Your Committee on Planning, to which was referred Bill No . 533 ,
regarding the rezoning request of Donald 011is, Et al . ,
Kohala Estates Subdivision, Kahua, Hawaii, TMK : 5-9-5 :16 , reports as
follows:
Bill No . 533 amends Section 25-95A, Article 3 , Chapter 25 of the
Hawaii County Code, by changing the district classification of
7 .127 acres of land from Unplanned (U) to Agricultural (A-3a) .
The applicant plans to subdivide the property into two lots and
construct a single family dwelling on one of the lots . He stated
that "Our lot is presently held as tenants in common with our two
adult sons . We wish to divide so that we can build on one half the
property and the sons can hold the other half . "
The Department of Public Works has recommended that appropriate
infrastructure be required if the Planning Department intends to
continue to approve rezoning requests . •
Water to the property is available from the Kohala Ranch Water
Company' s private water system. Other essential utilities and
services are available to the property .
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees , conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .

of Bill No . 533, Draft 2, and recommends that it pass first reading .
