Your Committee on Planning, to which was referred Bill No . 532,
regarding the rezoning request of Naoji Kawamata, Kohala Estates
Subdivision, Kahua, Hawaii , TMK : 5-9-5 :12 & 15 , reports as follows :
Bill No . 532 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
10 . 186 acres of land from Unplanned (U) to Agricultural (A-3a) .
The rezoning application involves two parcels of approximately five
acres each . The applicant plans to consolidate and resubdivide the
two properties into three lots .
According to the Planning Department, a single family dwelling and a
farm dwelling are located on one of the parcels . The other parcel
has a single family dwelling and an ohana dwelling.
According to the applicant , the properties are also used for growing
certain agricultural products : flowers on 1/4 acre; coconut on
1-1/2 acres and ornamental palms on 1-1/2 acres .
The Department of Public Works has stated that "An objection has been
voiced on numerous previous occasions, " referring to past rezoning
applications involving lots in Kohala Estates .
The General Plan designates the properties as Extensive Agriculture .
Water will be available from Kohala Ranch Water Company' s prviate
water system. The water company has committed to provide
1 , 800 gallons of water per day for the proposed subdivision.
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance :
SECTION 3. Should the council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees, conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
