Your Committee on Planning, to which was referred Bill No . 530 ,
regarding the rezoning request of Stella Chang, Kaauhuhu ,
North Kohala, Hawaii , TMK : 5-5-02 :Portion of 39 , reports as follows:
Bill No . 530 amends Section 25-95C, Article 3, Chapter 25 of the
Hawaii County Code , by changing the district classification of
82,737 square feet of land from Agricultural (A-20a ) to Single Family
Residential (RS-15 ) .
The applicant is also seeking State Land Use boundary amendment from
the Agricultural to the Urban district through Bill 529 .
The applicant plans to subdivide the property into three
15 ,000 square foot lots . The proposed three lots will not utilize
the entire 82 ,737 square feet of land being rezoned by Bill 530 . The
applicant plans to consolidate the remaining area, approximately
39 ,000 square feet , with portions of her property which is already
zoned for Residential use. This action will create a fourth lot
which will measure approximately 76 ,265 square feet in size and bear
. a zone designation of Residential (RS-15) .
The General Plan designates the area as Low Density Urban
Development . The State Land Use classification is Agricultural and
the North Kohala Community Development Plan designates the property
as RES-4 (4 units per acre) .
The Real Property Tax Division has stated, "The subject property was
in agricultural use from 1978 to 1986 and will be subject to rollback
taxes on either change in use or subdivision, whichever occurs first . "
Water and all essential utilities and services are readily available
to the property.
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the Council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees , conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
