Your Committee on Planning, to which was referred Bill No . 512.,
regarding the rezoning request of Olaf Lange, Kahua, North Kohala,
Hawaii , TMK : 5-9-06 :7 , reports as follows :
Bill No . 512 amends Section 25-95A, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
8 .79 acres of land from Unplanned (U) to Agricultural 3-acre (A-3a) .
The subject property is located within the Kohala Estates
Subdivision, Unit I, which consists of forty-six lots . According to
the Planning Department, six lots within Unit I have been rezoned to
A-3a during the past year .
The applicant plans to subdivide the property into two lots of
approximately four acres each . According to the applicant 's
representative, "One of these lots will be retained by the applicant
who intends to build his home and conduct agricultural activities on
the property. The other would be sold to a family member who has the
same interest as the applicant . "

Councilman Russell Kokubun raised the question as to why the
Fire Department is requiring- a 10 ,000 gallon holding tank for fire
fighting purposes and asked Planning Director Albert Lyman whether
the fire hydrants in Kohala Estates are functional . Mr . Lyman stated
that he was not sure but would look into this matter .
Councilman Sherwood Greenwell stated that the 10 ,000 gallon holding
tank is an unusual requirement since Kohala Estate residents are
paying for a water system.
The General . Plan designates the property for Extensive Agricultural
use . The State Land Use district classification is Agricultural .
The Land Study Bureau ' s productivity rating is Class "E" or
Very Poor . The property is not classified by ALISH. The Flood
Insurance Rate Map classifies the property as Zone "C" (Area of
Minimal Flooding . )

Water is available from Kohala Ranch Water Company' s private water
system. The applicant has received a commitment for 1 ,200 gallons
per day for the proposed development .
All other essential utilities and services are available to the
property.
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the Council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees, conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 512, Draft 2, and recommends that it pass first reading .
Note: Underscoring is being used in the committee report only and
will not appear in Bill 512.
