HomeMy WebLinkAboutREP PC 302 03/14/1988 1984-1988 - 411 REPORT OF THE411 COMMITTEE ON PLANNING DATE: March 14 , 1988 Re: 'Comm. 1505 PLACE : Councilroom TIME: 1: 30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 503 , regarding the rezoning request of Lillia Krieger , et . al . , North Kona, Hawaii , TMK : 7-9-12 :18 , reports as follows: Bill No . 503 amends Section 25-87 , Article 3, Chapter 25 of the Hawaii County Code , by changing the district classification of 7 .099 acres of land from Agricultural (A-5a ) to Residential-Agricultural (RA-la) . While the Planning Commission is recommending approval of the application, the Planning Director is recommending denial because the proposed rezoning violates Section 205-2, Hawaii Revised Statutes , and is inconsistent with the State Land Use Regulations and the General Plan . There are five single family dwellings on the property . The applicant plans to subdivide the property in five lots of approximately one acre each, to accommodate each of the five dwellings . According to the Planning Department, in addition to the five dwellings , a guest house is also located on the property . Of these six structures, only two of the dwelling units have all necessary permits. The Department of Agriculture has no objection to the zone change because the property already has several small scale orchards of avocado , macadamia nuts , coffee, banana and lychee.. According to the applicants , they will continue to farm the land . Current access to the property from Mamalahoa Highway is via a 50-foot road reserve which has an 8- to 10-foot wide pavement with 4-foot wide shoulders . The applicants stated that they plan to provide a new access to the proposed lots . Your Committee heard testimony from the applicant and her planning consultant in reference to a new access to the property. Your Committee suggested that access be provided via an extension of Mamao Street which currently ends at the southern boundary of the subject property . PC REPORT No . 302 ADOPTED : APR 61988 i 1 1 " III 111 ,a, , , PC- 302 Page 2 March 14 , 1988 The bill has been amended to include the following statement : c) a 50-foot right-of-way to allow for the eventual extension of Mamao Street to the northern boundary of the subject property shall be included at the time of subdivision approval . Your Committee has also amended Condition F of the bill to require the applicant to secure all required building permits prior to receiving final subdivision approval . The bill has been further amended to include the following statement regarding the proposed Unified Impact Fees Ordinance: SECTION 3 . Should the Council adopt a Unified Impact Fees Ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees, conditions included herein may at the developer 's election, be satisfied by performance in accordance with the requirements of the Unified Impact Fees Ordinance .
