Your Committee on Planning, to which was referred Bill No . 498 ,
regarding the rezoning request of Berenice Spalding, Ouli ,
South Kohala, Hawaii , TMK : 6-2-2:Portion of 5 , reports as follows :
Bill No. 498 amends Section 25-95F, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
13.27 acres of land from Single Family Residential (RS-15 ) and
Open (0) to Single Family Residential (RS-5a) .
The property is located at Waiulaula Point adjacent and to the north
of the 3rd Green and 4th Fairway of the Mauna Kea Beach Golf Course .
The applicant plans to subdivide the property into two lots of
approximately 8 .6 acres and 6 .4 acres . The applicant intends to sell
the 6 . 4 acre lot and retain the 8 .6 acre parcel , upon which her house
is located .
. . Access to the property is via a 40-foot wide easement with a •l2-foot
wide pavement which branches off from the Westin Mauna Kea Beach
Hotel access road . Water for the two proposed lots will be available
through a water commitment assigned to Mauna Kea Properties . Other
essential utilities and services are readily available to the
property .
The General Plan designates the property for Low Density Urban
development .
Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the Council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees , conditions included herein may at the develo er 's
election, be satisfied by performance in accordance
with the requirements of the Unified Impact Fees
Ordinance .
