Your Committee on Planning, to which was referred Bill No . 487 ,
regarding the rezoning request of Harry Foster, Kalaoa, North Kona,
Hawaii , TMK: 7-3-5 :87 , reports as follows :
Bill No. 487 amends Section 25-87, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
5 .655 acres of land from Unplanned (U) to Single Family Residential
(RS-10 ) .
The State Land Use Boundary Map is being amended as per
Ordinance 86-126 which establishes procedures for the County to amend
State Land Use boundaries of properties of fifteen acres or less ,
except those lands within the Conservation District .
Ordinance 86-126 also allows the simultaneous processing of boundary
amendments with other land use amendments and permits .
. The applicant plans to subdivide the property into seventeen
residential lots . The property is located adjacent to the Kona
Palisades Subdivision.
According to the Planning Department, ancient grave sites and other
archaeological features are located on the property.
The General Plan designates the property as Extensive
Agriculture/Alternate Urban Expansion. The State Land Use
classification is Agriculture. The Kona Regional Plan designates the
area for residential use. The zoning designation is currently
Unplanned (U) .
Although the State Land Use designation of the property is
Agriculture , the Department of Agriculture has stated that "The
Department of Agriculture is of the opinion that approval of the
subject proposal will not adversely affect the agricultural resources
of the area nor the plans, programs and activities of the Department . "
Water and all essential utilities and services are readily available
to the property.

Your Committee has amended the bill to include the following
statement regarding the proposed Unified Impact Fees Ordinance:
SECTION 3 . Should the council adopt a Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees , conditions included herein may, at the
developer ' s election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance .
Your Committee has also amended the bill to add a new Condition I,
which requires the applicant to submit annual progress reports to the
Planning Department . This condition, which will hereafter be
required of larger developments, was inadvertently left out of
Bill 487 . The amendment reads as follows :
( I) an annual progress report shall be submitted to
the Planning Director prior to the anniversary date of
the effective date of the zone change. The report
shall address the status of the development and the
compliance with the conditions of approval . This
condition shall remain in effect until all of the
conditions of approval have been complied with and the
Planning Director acknowledges that further reports are
not required;
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 487, Draft 2, and recommends that it pass first reading.
NOTE : Underscoring is being used in the committee report only and
will not appear in the final draft of Bill 487 .
