Your Committee on Planning, 'to which was referred Bill No. 455 ,
regarding the rezoning request of Railroad Avenue Partners, Waiakea,
South Hilo, Hawaii , TMK: 2-1-12 :26, reports as follows :
Bill No. 455 amends Section 25-114, Article 3, . Chapter 25 of the
Hawaii County Code by changing the district classification of
approximately 4.49 p.cres of land from General Industrial - 1 acre
(MG-la) to Limited Industrial - 1 acre (ML-la) .
The applicant leases the subject property from the State of Hawaii .
The State has authorized the applicant to submit the change of zone
request .
Bill 455 passed first reading of the Council on January 18, 1988, and
was ' recommitted to the Planning Committee at the recommendation of
Committee Chairman Takashi Domingo. This action was taken to enable
your Committee to amend the bill to include the following statement
regarding the proposed Unified Impact Fees Ordinance:
Section 3. Should the council adopt A Unified Impact
Fees Ordinance setting forth criteria for the
imposition of exactions or the assessment of impact
fees, conditions included herein may, at the
developer 's election, be satisfied by performance in
accordance with the requirements of the Unified Impact
Fees Ordinance.
Your Committee on Planning is now in full accord with the intent and
purpose of Bill No. 455, Draft 2, and recommends that it pass second
and final reading.
