Your Committee on Planning, to which was referred Bill No. 473 , which
amends Section 2 of Rezoning Ordinance No. 515 , reports as, follows:
The purpose of Bill 473 is to amend Section 25-95H, Chapter 25 of the
Hawaii County Code,, relating to the modification of Ordinance No . 515
which reclassified certain lands from Multiple Family Residential
(RM-3 .0) to Village Commercial (CV-10) and from Village Commercial
(CV-10 ) to Multiple Family Residential (RM-3 .0) at Waikoloa,
South Kohala, Hawaii , covered by Tax Map Key 6-8-03 : 6 & 7 .
The applicant had initially requested that the condition in
Ordinance 515 which imposed time requirements on construction be
deleted and that the Village Commercial zoningbe allowed to stand
without conditions .

The Planning Commission agreed with the Planning Director that this
request should be denied because: "By deleting the construction
an
condition, the applicant proposesopen-ended commercial-zoned
district with no performance expected. This, in effect , would be
contrary to the findings of promoting public necessity and the
general welfare . The denial is also supported by the Courses of
Action set forth in the Land Use Element - South Kohala Profile which
reads, "controls to insure orderly development and minimize
speculation of commercially zoned lands shall be established. "
The Planning Commission did, however , as recommended by the
Planning Director , amend Section 2 to grant the applicant a one-year
time extension and to update the section so as to bring the rezoning
conditions more in line with more recently approved rezoning
ordinances .
