HomeMy WebLinkAboutREP PC 270 12/07/1987 1984-1988 411 -REPORT OF THE P COMMITTEE ON PLANNING DATE : December 7 , 1987 Re: /C-1342 PLACE : Councilroom TIME : 1 : 30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 441, regarding the rezoning request of Taiyo Hawaii Co . , Ltd . , North Kona , Hawaii , TMK : 7-5-10 : 8 & 57 , reports as follows : Bill No . 441 amends Section 25-87 , Article 3 , Chapter 25 of the Hawaii County Code, by changing the district classification of 28 .7 acres of land from Unplanned to Multiple Family Residential (RM-4) , Neighborhood Commercial (CN-20 ) and Open (0) . According to the Planning Department , the applicant plans to construct 240 duplex units in 120 one-story structures . The applicant has also incorporated into the project plans , two parks for passive recreational activities . These parks will be for the exclusive use of residents within the project . They will be developed and maintained' by the applicant, successor or its assigns . The applicant also plans to make land available for a preschool or day care center . Bill 441 passed first reading of the Council on December 2, 1987 , and was recommitted to the Planning Committee on the recommendation of Committee Chairman Takashi Domingo. Your Committee discussed several issues involving the proposed project , such as : 1 . The appropriateness of requiring the developer to improve Nani Kailua Drive , a public roadway located outside of the proposed' development, with curbs, gutters and sidewalks . 2 . The appropriateness of requiring the two 20 ,000 square foot parks , which the developer is voluntarily providing, to be located and identified by metes and bounds this early in the development phase . Your Committee felt that metes and bounds description will make it difficult to move , even slightly , the location of the parks , if and when this is necessary . If the bill defines the park sites by metes and bounds , every change in location will require the zoning ordinance to be amended . • PC REPORT No , . ADOPTED : DEC 14 1987 . . f t • PC- 270 Page 2 December 7 , 1987 3 . The necessity to include, in the bill, the site of the proposed private preschool center . The developer will voluntarily provide the land for a center , if a preschool operator can be located . Your Committee felt that the developer should be free to use the proposed site for other purposes if a center operator cannot be found . 4 . The need to amend the statement involving the Unified Impact Fee Ordinance so that it will clearly offer the developer a choice of: 1 ) satisfying all of the conditions as set forth in the bill or 2) performing the requirements of the Unified Impact Fee Ordinance , if such an ordinance is adopted by the Council . Your Committee decided to forward the bill to the Council at which time appropriate and necessary amendments will be introduced .
