Your Committee on Planning, to which was referred Bill No . 450 ,
regarding a request for time extension to meet the requirements of
Condition D of Change of Zone Ordinance No . 84-9., reports as follows :
The purpose of Bill 450 is to amend Section 25-87 , Article 3 ,
Chapter 25 of the Hawaii County Code, relating to the modification of
conditions to Ordinance No . 84-9 and further amended by Ordinance
No . 86-94 , which reclassified certain lands from Unplanned (U) to
Open (0 ) and Limited Industrial (ML-la) at Keahuola, North Kona ,
covered by Tax Map Key 7-4-08 :portion of 2.
The Planning Commission states that "The change of zone application
was originally filed by Kuakini Corporation who had a development
agreement with Liliuokalani Trust to create a 76-lot industrial
subdivision and related improvements . The original applicant filed
for Chapter 11 bankruptcy and Liliuokalani Trust has had to assume
the obligations of the applicant . According to the request letter ,
the Trust intends to fulfill its obligations to complete the
industrial subdivision . "
Condition D requires the developer to submit subdivision plans for
the first increment within one year from the effective date of zone
change . This condition is amended to require the developer to submit
subdivision plans within one year from the effective date of this
amendment .
The bill is also amended to include Condition Q which incorporates
conditions upon which time extensions may be granted .
