Your Committee on Planning, to which was referred Bill No . 441,
regarding the rezoning request of Taiyo Hawaii Co . , Ltd . , North Kona ,
Hawaii , TMK : 7-5-10 :8 & 57 , reports as follows :
Bill No . 441 amends Section 25-87 , Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
28 .7 acres of land from Unplanned to Multiple Family Residential
(RM-4) , Neighborhood Commercial (CN-20 ) and Open (0) .
According to the Planning Department , the applicant plans to
construct 240 duplex units in 120 one-story structures . The
applicant has also incorporated into the project plans, two parks for
passive recreational activities . These parks will be for the
exclusive use of residents within the project . They will be
developed and maintained by the applicant, successor or its assigns .
The applicant also plans to make land available for a preschool or
day care center .
According to the Planning Department, the applicant has stated that
"To create an aesthetically pleasing environment all utilities ,
including cable television service, shall be placed underground and
all areas fronting private roadways and public streets , common areas ,
and park sites shall be landscaped."
Committee Chairman Domingo recommended that the bill be forwarded to
the Council for first reading and be recommitted to Committee for the
purpose of amending the metes and bounds of certain features of the
proposed development .
Councilman Kokubun inquired as to whether amendments to the bill will
include a statement making reference to the pending Uniform Impact
Fees Ordinance . Chairman Domingo answered in the affirmative .
Councilmembers. Sc.hutte and Herkes stated that , according to the bill ,
the developer is being required to install numerous improvements ,

including but not limited to: curbs, gutters, sidewalks and traffic
signals . Councilmembers Schutte and Herkes felt that the statement
making _reference to the proposed Impact Fees Ordinance should not be
included in Bill 441 . They felt that the developer should not be
burdened with additional financial requirements .
Councilwoman Jitchaku-Inouye asked Corporation Counsel for an opinion
as to whether the Council may selectively include the Impact Fees
statement in certain rezoning applications or whether it should be
included in all applications . Corporation Counsel 's opinion will be
forwarded to the Council at a later date .
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 441 and recommends that it pass first reading and be
recommitted to the Planning Committee.
