Your Committee on Planning, to which was referred Bill No . 435 ,
regarding the General Plan amendment request of Kahala Capital
Corporation, NorthHawaii ,
Kona, TMK : 7-2-04 :3 , reports as follows :
Bill No . 435 amends the County of Hawaii General Plan as originally
adopted by Ordinance No . 439 and as amended by Ordinance Nos . 456 ,
87-49 , 87-52 and
822, 854 , 868 , 878 , 83-20 , 84-40 ,
475 , 484 , 538 ,
87-68 , by redesignating approximately 349 acres of land from
Conservation and Open to Resort , Medium Density Urban and Open.

An Environmental Impact Statement (EIS ) was filed for the General
Plan Amendment petition covering the subject property and proposed
development plans . The EIS was accepted by the Planning Department
on March 5 , 1987 .
According to the EIS, "The central element of the development concept
is the creation of a self-contained, intermediate resort development
with an 18-hole golf course. " The EIS further states that the
development will include the following improvements:
I . Resort designation
A. A 600 room hotel overlooking Kahoiawa Bay.
II. Medium Density Urban designation
A. Condominium development - Approximately 900 condominium
apartments .
B . Commercial development -- Two retail/commercial areas .
Open designation
A. A par-72, 18-hole championship golf course and clubhouse .
The Petitioner has not , as yet, filed a formal petition with the
State Land Use Commission to amend the State Land Use Boundary from a
Conservation District to an Urban District .

exceptionThe County of Hawaii General Plan designates the area as Conservation
with an open designation along the coastline. The Kona Regional Plan
recommends that the area remain Conservation and open. The property
is located within the County's Open zoned district.

Your Committee heard testimonies from several speakers recommending
that action on • o deferred o
Bishop Estates' Makalawena project which is presently before the
Planning Commission. The speakers felt that Awake'e and Makalawena
should be considered and viewed as a single unit.
Sandra Schutte, attorney for the applicant, disagreed with the
speakers and informed the Committee that major differences exist
between Awake'e and Makalawena. She explained that Awakele and
Makalawena are owned by different entities and that property owners
or developers very seldom work together because of various reasons.
The land use density of the two projects also differ greatly.
Makalawena is proposing to develop 1,200 hotel rooms in two
seven -story buildings, while Awake®e is planning on 600 hotel rooms
in several low-rise buildings.
Mrs. Schutte also explained that Awake'e and Makalawena will each
have their own access road from the highway, keeping the two projects
physically separated. She added that these are two separate parcels
of land with different concerns which should be dealt with
individually.
Councilwoman Jitchaku-Inouye expressed concern over General Plan land
use changes involving lands surrounding the anchialine ponds.
Mrs. Schutte stated that the area of the ponds will be designated for
Open Use and will be left untouched except for management purposes.
Mrs. Schutte stated that regardless of what the land use designation
is, the developer is committed to maintaining the ponds under a
pre -agreed upon pond maintenance plan.
The Committee was informed by a representative of the Planning
Department that Council members will be able to make specific
recommendations regarding protection of the ponds and other specific
aspects of the project during the rezoning process.

Your Committee on Planning is in accord with the intent and purpose
of Bill No® 435 and recommends that it pass first reading.
