Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 411 , regarding the rezoning request of Mr . and Mrs . Marieto dela Cruz , Waiakahiula, Puna, Hawaii , TMK: 1-5-03 :portion of parcel 37 , reports as follows: Bill No . 411 amends Section 25-107 , Article 3 , Chapter 25 of the Hawaii County Code , by changing the district classification of approximately .68 acres of land from Single Family Residential (RS-10 ) to Neighborhood Commercial (CN-20 ) . Bill 411 passed first reading of the Council on October 21, 1987 and was recommitted to the Planning Committee at the recommendation of Committee Chairman Takashi Domingo . This action was taken to allow the Planning Department time to recommend development conditions which should be included in the bill . Development conditions were omitted from the bill since the Planning Department and Planning Commission had recommended denial of the application . Communication No . 1257 .1 is a list of development conditions which the Planning Department is recommending be included in Bill 411 . Your Committee agrees with the Planning Department 's proposed list of conditions , except for item E, which requires the applicant to install curbs , gutters and sidewalks . As such, Bill 411 has been amended to include the recommendations of the Planning Department, as proposed in Communication 1257 .1 , with the exception of item E . These items are listed in Bill 411 as Conditions A to F. Your Committee has further amended the bill to include: 1 . Condition G which outlines standard conditions governing the granting of time extensions and 2 . SECTION 3 . Should the council adopt a Uniform Impact Fees Ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees , conditions included herein may be satisfied by performance in accordance with the requirements of the Uniform Impact Fees Ordinance . PC REPORT No . 257 ADOPTED : NOV 1 8 1987 �y . .s S • PC- 257 Page 2 November 9 , 1987 Your Committee decided against including the condition that curbs, gutters and sidewalks be installed along the property line fronting the existing Kalapana Road, as recommended in item E of Communication No . 1257 .1 . Your Committee felt that it would be unreasonable to impose this requirement because: 1 . The subject property is technically an island with no adjoining developable properties; therefore , there will probably be no pedestrian traffic . 2 . If the requirement for curbs and sidewalks is meant to prevent on-street parking or to limit access to the property, the construction of berms or the imposition of a planting easement along the property line may just as adequately serve these purposes . 3 . Tentative plans are to close the old Kalapana Road a short distance south of the subject property. If this plan is implemented, Kalapana Road will , in effect , become a driveway to the subject property . Your Committee on Planning is now in full accord with the intent and purpose of Bill No . 411 , Draft 2 , and recommends that it pass second and final reading.
