Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 429 , regarding the rezoning request of Ira Leitel/James Brand , Kaauhuhu Homesteads , North Kohala, Hawaii , TMK: 5-5-01:26 , reports as follows: Bill No . 429 amends Section 25-95B, Article 3 , Chapter 25 of the Hawaii County Code , by changing the district classification of 9 .49 acres of land from Agricultural (A-20a) to Agricultural (A-3a) . The subject property is owned by the applicants, Dr . and Mrs . James Brand and Mr . and Mrs . Ira Leitel . There are two single-family dwellings on the property which are occupied by the applicants ® The applicants plan to subdivide the property into two parcels , one 5 acres in size and the other 4 .49 acres . According to the applicant, "The purpose of this is , obviously, to allow each of the families to own separate , divisible parcels in order to permit the heirs of the owners (both families have children ) to inherit and succeed to separate fee-simple interests . " Your Committee has amended the Bill to include a new section relating to the proposed Uniform Impact Fees Ordinance . The amendment reads as follows: "Should the council adopt a Uniform Impact Fees Ordinance setting forth criteria for the imposition of exactions or the assessment of impact fees , conditions included herein may be satisfied by performance in accordance with the requirements of the Uniform Impact Fees Ordinance ." The property is classified zone "C" , area of minimal flooding by the Flood Insurance Rate Map. The Land Study Bureau classifies the land "C" or Fair . The land is classified "Prime" by ALISH, The Kohala Community Association (Planning and Land Use Committee ) stated that "Our Committee has no reservations about this application . This subdivision seems to be appropriate for the area . " Water and other essential utilities and services are available to the property .
