Your Committee on Planning, to which was referred Bill No . 411 ,
regarding the rezoning request of Mr . and Mrs . Marieto dela Cruz ,
Waiakahiula , Puna , Hawaii , TMK: 1-5-03 :portion of parcel 37 , reports
as follows:
Bill No . 411 amends Section 25-107 , Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
approximately .68 acres of land from Single Family Residential
(RS-10 ) to Neighborhood Commercial (CN-20 ) .
The Planning Director and Planning Commission are recommending that
the application be denied based on the following findings of the
Planning Department:
1 . The commercial core of Pahoa is generally the area
between the Pahoa Post Office and Paul 's Repair Shop .
2 . Development of the subject property would be contrary to
the continued growth of the commercial core .
3 . Approval of this application would encourage other
commercial developments to occur along the Pahoa Road .
4 . The property is bordered on all sides by government
roadways .
According to the Planning Department, a property located
approximately 200 feet north of the subject property was granted a
Special Permit by the Planning Commission to construct a restaurant
and store .
Although the property is bordered to the north by the proposed
Keaau-Pahoa Road , access to the property will be limited to the
present Kalapana Road .

of Bill No . 411 and recommends that it pass first reading .
