Your Committee on Planning, to which was referred Bill No . 415 ,
regarding the rezoning request of Kona Operating
Partnership/Kaupulehu Developments , Kona Village Resort, Kaupulehu ,
North Kona, Hawaii , TMK : 7-2-03 : portions of 1 & 2 , reports as follows:
Bill No . 415 amends Section 25-86 , Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
approximately 48 acres of land from Resort Hotel - 3 ,000 square foot
(V-3 ) and Open (0) to Resort Hotel - 7 ,000 square foot (V-7 ) .
The applicants are simultaneously requesting a Special Management
Area (SMA) Use Permit to allow the expansion and renovation of the
existing Kona Village Resort, including the construction of 50 new
units and related improvements .
According to the Planning Department, the applicants are requesting
that 15 acres of the existing V-3 zoned lands be rezoned to V-7 . The
remaining 33 acres will be rezoned from Open to V-7 . Based on a
density of 7 ,000 square feet of land area per unit , a maximum of
about 298 units may be allowed for the 48 acres .
The current density of 3 ,000 square feet of land area per unit for
the existing 15 acres of V-3 zoned lands will permit 217 units to be
constructed .
Although 298 units may be constructed on the rezoned lands , the
applicants plan to limit construction to 50 additional units at the
Kona Village Resort . The resort currently has 100 units .
The 50 additional units will be constructed in two phases with each
phase involving 25 units . The applicants hope to complete Phase I by
December 1989 . The beginning of Phase II will depend on market
demand and economic feasibility .
The General Plan designates the area as an Intermediate Resort Area .
The Kona Regional Plan recognizes the village and surrounding area as
an Intermediate Resort Area . The State Land Use Commission
designates the property as an Urban District .

The entire property is situated within the Special Management Area
(SMA) ; thus , the applicants have submitted an SMA Use Permit
application .
According to the Planning Department, the applicants have formulated
a Master Shoreline Access Plan that will provide public access to and
along the shoreline . The department further stated that "In
addition, Kona Operating Partnership is working to satisfy an
unresolved public access condition of its original SMA Use Permit .
Public pedestrian access and parking are expected to be provided by
December 31 , 1987 , with permanent public facilities to be constructed
thereafter . "
With the aid of a map, Mrs . Jan Sullivan of Takeyama and Sullivan ,
attorneys for the applicant , and Mr . Fred Duerr , of Kona Village ,
showed the members of your Committee the location of the proposed
shoreline access easement . According to Mrs . Sullivan , the access
road should be completed in early 1988 .
Councilman Kokubun asked Mrs . Sullivan if she knew about how far away
the parking lot would be located from the shoreline . Mrs . Sullivan
said that it would be about half a mile away. She added that
Kona Village will provide one public parking area for every ten hotel
units .
As suggested by Committee Chairman Takashi Domingo , your Committee
has amended Condition G of the bill to add the following statement:
"if the applicant should require an additional extension of time , the
Planning Director shall submit the applicant ' s request to the
County Council for appropriate action ."
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 415 , Draft 2 , and recommends that it pass first reading.
Note: Underscoring is used in this committee report only and will
not appear in Draft 2 of Bill No . 415 .
