Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 413 , regarding the rezoning request of Waiakea Acres , Waiakea , South Hilo , Hawaii , TMK: 2-4-34 : 17 , reports as follows: Bill No . 413 amends Section 25-114 , Article 3 , Chapter 25 of the P Hawaii County Code , by changing the district classification of approximately 28 .74 acres of land from Agricultural (A-3a ) to Agricultural (A-1a) . The subject property is located in Waiakea Uka and fronts Ainaola Drive . The applicant plans to subdivide the property into twenty five 1-acre parcels for residential/agricultural uses . The General Plan designates the property for Low Density Urban Development . Such a designation may allow residential uses at a maximum density of four units per acre . The Hilo Community Development Plan designates the property as Agricultural (A-3a ) and Alternate Residential Expansion. The State Land Use Commission designates the land for agricultural uses . A majority of the land is classified as "Prime Agricultural Land" by the Agricultural Lands of Importance to the State of Hawaii (ALISH) system. Small areas in the southeast and southwest corners of the property are not classified . The Flood Insurance Rate Map (FIRM ) designates the majority of the property as Zone "A" (Areas subjected to 100-year flooding ) . Councilwoman Merle Lai questioned Norman Hayashi of the Planning Department as to the status of the drainage study referred to in the Planning Commission 's transmittal letter of September 9 , 1987 . Mr . Hayashi stated that the study has been completed and added that the applicant has been working with the Department of Public Works on the study since 1985 , when he first applied for rezoning of the subject property . PC REPORT No . 242 ADOPTED : OCT 7 1987 , !II PC- 242 Page 2 September 21 , 1987 Adjacent lands to the north and east are zoned A-la, while lands to the south and west are zoned A-3a . The Department of Agriculture stated, in part, that "It appears from the applicant 's information that the purpose of the subdivision is to create lots that are primarily residential in nature, and the agricultural component of the zoning request consists principally of informal 'backyard ' activities . Section 205-2 of the Hawaii Revised Statutes requires that any dwellings constructed on the proposed lots be accessory to an agricultural use (emphasis added) . " As suggested by Committee Chairman Takashi Domingo , your Committee has amended Bill 413 to add the following statement to the condition involving the granting of time extension: "if the applicant should require an additional extension of time , the Planning Director shall submit the applicant 's request to the County Council for appropriate action ." Your Committee on Planning is in accord with the intent and purpose of Bill No . 413 , Draft 2 , and recommends that it pass first reading .
