Your Committee on Planning, to which was referred Bill No . 412 ,
regarding the rezoning request of William Brilhante , Waiakea,
South Hilo , Hawaii , TMK: 2-2-37 :27 , reports as follows:
Bill No . 412 amends Section 25-114 , Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
21 ,050 square feet of land from Single Family Residential (RS-10 ) to
Limited Industrial (ML-20 ) .
The subject property fronts Kanoelehua Avenue and is adjacent to
Magoo 's Auto Parts .
According to the Planning Department, the applicant plans to
construct a 4 ,500 square foot warehouse building. The applicant
states that the building will not exceed 30 feet in height .
Councilman Russell Kokubun questioned Norman Hayashi of the
Planning Department on whether the department has the means to
measure "nuisance" qualities as implied in Condition E of the bill
which states , in part, that "any activity conducted on the property
shall not constitute a nuisance to the surrounding properties .
Mr . Hayashi stated that the department does not possess
such
capabilities; therefore , relies solely on complaints from neighboring
property owners .
At the suggestion of Committee Chairman Takashi Domingo , your
Committee has amended Bill 412 to add the following statement to the
condition involving the granting of time extensions: "if the
applicant should require an additional extension of time , the
Planning Director shall submit the applicant 's request to the
County Council for appropriate action. "
The General Plan designates the property for Industrial uses . The
State Land Use Commission designates the property as Urban .
All essential utilities and services , including water , are available
to the property .
