Your Committee on Planning, to which was referred Bill No . 410 ,
regarding Condition E of Change of Zone Ordinance No . 86-107 ,
John Bellman , Pahoa , Waiakahiula, Puna , TMK: 1-5-13 : 26 , 27 & 44 ,
reports as follows:
The purpose of Bill 410 is to amend Condition E of Ordinance 86-107 .
In support of the amendment , the Planning Commission stated that "The
granting of the request to amend Condition E of Ordinance No . 86 107
by reducing the road widening strip from 15 to 10 feet , and to allow
the use of this strip for parking purposes until such time that
roadway improvements are made to this road widening strip, will not
be contrary to the original reason used in granting the change of
zone application . "
The Department of Public Works stated that it did not object to the
request to decrease the road widening strip along the frontage of the
subject property from 15 to 10 feet . The department stated that "The
proposed widening of Pahoa Road can be accommodated with a 10 ' strip
fronting the subject parcel . "
Condition .E is amended to read as follows :
"E. a 10-foot wide road widening strip along the length of
Pahoa Road shall be delineated on the plans submitted for
plan approval review . No structural improvements shall be
allowed within this road widening strip. Further , the
applicable building setbacks shall be taken from the future
road widening strip. Any required parking , landscaping or
curbs , gutters and sidewalks may be allowed within this road
widening strip, provided that when improvements are made to
widen the Pahoa Road, the applicant, successors or assigns
shall be required to remove any improvements within this
10-foot wide strip which are not related to the road
widening project and shall provide the parking as then
required by the Zoning Code (Hawaii County Code , Chapter 25 ,
as amended ) ; "

Your Committee on Planning is in accord with the intent and purpose
of Bill No. 410 and recommends that it pass first reading .
