Chairman and Members • Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 399 , regarding the rezoning request of Robert Carlsmith , et al , Kailua-Kona, Hawaii , TMK : 7-5-04 :Portion of 29 , reports as follows: Bill No. 399 amends Section 25-89 , Article 3 , Chapter 25 of the Hawaii County Code, by changing the district classification of .706 acre of land from Agricultural (A-la ) to General Commercial (CG-20 ) . The subject property fronts the Hawaii Belt Road and is adjacent to the Lanihau Shopping Center property . According to the Planning Department, the applicant has no specific building plans at .the present time. Their current plans are to either lease the property for commercial use or to build to suit a tenant . Neighboring properties are zoned for commercial uses . The General Plan designates the property for High Density Urban uses . The State Land Use Commission classifies the- property as Urban and the Kona Regional Plan designates the property for General Commercial uses . • The subject property falls within the Kailua Village Design District . The Kailua Village Design Commission , at its March 23 , 1987 meeting, voted to recommend approval of the rezoning request . Chairman Takashi Domingo questioned the Planning Director as to -why the Department of Public Works ' recommendation that the applicant be required to contribute toward the cost of installing traffic signal . improvement at the entrance of Lanihau Shopping Center along Palani Road is not included in the rezoning ordinance . The Planning Director called on Robert Carlsmith , one of the applicants , to explain to th-e Committee the agreement that his group has with Lanihau Corp. According to Mr . Carlsmith , Lanihau Corp. • will assume their (Mr . Carlsmith 's group ) share of the cost of installing traffic signal improvements in return for the right to include their easement as part of the shopping center ' s parking lot . • PC REPORT No SEP 2 P.: . ADOPTED : ___— - • • .' . , PC-235 Page 2 August 10 , 1987 In discussing this matter further with the Planning Director , committee staff learned that the easement referred to by Mr . Carlsmith is a road easement, in favor of the applicant, which runs from Palani Road, near the First Hawaiian Bank property, to the subject property. According to the Planning Director , if this agreement had not been arrived at, Lanihau Shopping Center would have had a road easement running through the parking lot . In another matter, Chairman Domingo suggested that Condition (G) of Bill 399 be amended to: (1 ) allow the Planning Director to grant the developers an initial extension of time to meet various development conditions and ( 2) require the Planning Director to forward subsequent time extension requests to the Council for appropriate action . Condition (G) of Bill 399 has been amended by adding a new subsection e ) to read as follows: e) if the applicant should require an additional extension of time, the Planning Director shall submit the applicants ' request to the County Council for appropriate action . Water and other essential utilities and services are available to the property . Your Committee on Planning is in accord with the intent and purpose of Bill No. 399 , Draft 2 , and recommends that it pass first reading .
