HomeMy WebLinkAboutREP PC 230 06/23/1987 1984-1988 S REPORT OF THE 411 • COlMpI T TEE ON PLANNING DATE: June 23 , 1987 Re: "C-557 PLACE : Councilroom TIME: 1: 30 p.m. • Chairman and Members Hawaii County Council Hilo ; Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 177 , regarding the rezoning request of Helen Leong, Kealakehe, North Kona, Hawaii , TMK: 7-4-04 :45 , reports as follows : The purpose of this bill is to amend Section 25-81 (North Kona Zone Map) Article 3 , Chapter 25 of the Hawaii County Code, by amending the district classification of approximately 25 ,265 square feet of land from Agricultural (A-la ) to Single Family Residential 10 ,000 square feet (RS-10 ) . The area involved is situated along the north side of Tomi Tomi Road, approximately 500 feet east of the Tomi Tomi Road-Palani Road junction in the Kealakehe Homesteads Subdivision . The applicant plans to subdivide the property into two lots: 10 ,000 and 15 ,625 square feet in size . She plans to give the 10 ,000 square foot lot to her sister and keep the other for herself . She does not intend to sell either of the lots . At its March 19 , 1986 meeting, the Planning Commission voted to forward a denial recommendation to the County Council . In its letter dated April 29 , 1986 , the Commission stated that "There are basically two concerns regarding this particular application . " The two concerns are: 1 . Access to the property . The Public Works Department believes that it is inadequate in size . The Planning Department believes that approval of this application may prompt adjacent property owners to seek similar rezoning and 2. An inadequate supply of water . The Water Department has stated that "water is not available for the proposed 2-lot subdivision until additional sources and transmission facilities are constructed and that the petitioner is not a participant in the Kona Source Agreement . " At the May 13 , 1986 Planning Committee meeting, Councilman Schutte stated that he finds it difficult to understand why the Planning Department and Planning Commission are recommending denial of Bill 177 because the application merely calls for the creation of two lots and neighboring properties are already zoned RS-10 and RS-7 .5 . PC RF PORT No , ADOPTED : JUL 1 ` .. t r 411 411 ,, 1 PC-230 Page 2 June 23 , 1987 Council Chairman Yamashiro suggested that if the County ' s concern is that the applicant and her sister may eventually increase the density of the property by building "Ohana" houses , the Planning Department should inquire of the applicant as to whether or not she would be willing to voluntarily waive her "Ohana" rights . The Committee deferred action on Bill 177 pending receipt of additional information from the Planning Department . On June 16 , 1986 , the Planning Director wrote to Chairman Domingo to inform him that in response to queries from the Planning Department , the applicant decided against voluntarily waiving her "Ohana" `rights .
