Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 369 , regarding the rezoning request of Mauna Lani Resort , Inc . , Waikoloa , South Kohala , Hawaii , TMK: 6-8-1: 52 , reports as follows: Bill No . 369 amends Section 25-95A, Article 3 , Chapter 25 of the Hawaii County Code, by changing the district classification of 1 .1 acres of land from Unplanned (U) to Agricultural (A-1a ) . The subject property is located along the makai side of the Queen Kaahumanu Highway , approximately one mile north of the Mauna Lani Resort entry road . The purpose of this zone change is to subdivide a 1 .1-acre area from a much larger parcel . The applicant intends to construct a fire and emergency station on the 1 .1-acre parcel . There will also be a police substation which will be used by beat officers . In July 1986 , the Planning Commission approved Special Permit No . 619 to allow the construction of a fire and emergency service facility on the 1 .1-acre parcel . • The proposed development will be funded through the issuance of general obligation bonds approved by the County of Hawaii . The Kohala Coast Resort Association will make payments to the County of Hawaii equal to the payments due on the bonds , pursuant to a debt service agreement with the County. Councilman Kokubun commended Mauna Lani Resort for their efforts in constructing the fire station on their property ; however , he stated that rezoning the parcel to Agriculture 1-acre and using it as the site of the fire station will be an improper use of the property. He added that the practice of rezoning land to 1-acre agricultural lots when the lots are not intended to be used for agricultural purposes should cease . Councilman Kokubun stated that the Zoning Code has provisions for rezoning large parcels of land for Residential and Agricultural (RA) uses. The RA district allows non-agricultural uses . He added that the County now has the authority to change the State land use PC REPORT NO . —227 JUN51997 ADOPTED : _�. +-1 111 411 PC- 227 Page 2 May 26 , 1987 boundary for any parcel of land 15 acres or smaller , without involving the State Land Use Commission ; therefore , this route should have been pursued by the Planning Department . A representative of the Planning Department stated that the subject rezoning application was received prior to the enactment of the ordinance granting to the County the authority to unilaterally change State land use boundaries of properties 15 acres or smaller . Councilman Schutte stated that the use of every parcel of agricultural zoned land should not be strictly limited to agricultural uses .
