Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No . 337 , regarding the rezoning request of Nicholas Raimondo, Ooma 1st, North Kona, TMK: 7-3-07 : 44 , reports as follows : Bill 337 amends Section 25-87, Article 3, Chapter 25 'of the Hawaii County Code , by changing the district classification of approximately 4. 47 acres of land from Unplanned (U) to Agricultural 1-acre (A-la ) . The applicant plans to subdivide the property into four lots with each lot containing at least one acre of land . The General Plan designates the property as Extensive Agriculture and Alternate Urban Expansion. The State Land Use designation is Agriculture . The Kona Regional Plan suggests a residential agricultural density of 1/2 acre to 3 acres . The Land Study Bureau' s overall master productivity ratings for agricultural use are Class "D" or poor and Class "E" or very poor . The Planning Commission, in its letter to the Council Chairman, stated that "While the ultimate result would be the creation of lots for residential purposes that would increase the density of the area, the proposal could still enhance agricultural opportunities on a limited basis . The applicant has stated that "The existing 4-acre lot is not suitable for profitable agriculture . " In reference to proposed use of the lots , the applicant stated, "Gentleman farming only with residential homes . Soil is rocky with little or no top soil . "Councilman Russell Kokubun querried a representative of the Planning Department as to why they did not advise the applicant that if the subject property is neither suitable nor meant for farming on a commercial level , a more appropriate zoning designation would be Residential and Agricultural . While a Residential and Agricultural zone would apply only to properties designated as Rural by the State Land Use Commission, the Council recently approved an ordinance giving the county the authority to amend State land use boundaries affecting properties less than 15 acres in size . • • PC REPORT No . 213 ADOPTED : A 15 1987 PC_ 213 Page 2 April 7 , 1987 Therefore, although the State land use boundary of the subject property is Agriculture , the boundary amendment process for the applicant will be neither costly nor lengthy. It could even be done simultaneously with the rezoning process . The Planning Department 's reason for not going this route was that the Mayor had not as yet signed the ordinance mentioned above , at the time Mr . Raimondo applied for rezoning of his property. The applicant was represented at the meeting by his consultant , Donald McIntosh . Mr . McIntosh was instructed to ask Mr . Raimondo as to whether or not he would be willing to reapply for a Residential and Agricultural zoning designation . Action on Bill 337 was deferred , pending a reply from Mr . Raimondo . Mr . Raimondo 's reply 1 was received via a letter from Mr . McIntosh to Committee Chairman Takashi Domingo , dated March 16 , 1987 , and identified as Communication No . 975 .1 . According to Communication 975 .1 , the applicant "would prefer to continue on the rezoning as it is now proceeding through the Council ." The communication further states that Mr . Raimondo would be willing to seek a General Plan amendment after the rezoning is approved if the Council should so require .
