Your Committee on Planning, to which was referred Bill No . 346 ,
regarding the rezoning request of Dexter Matsui , Kurtistown, Puna ,
Hawaii , TMK: 1-7-02: 7 , reports as follows:
Bill No. 346 amends Section 25-105 , Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
9 .7 acres of land from Agricultural (A-5a ) to Agricultural (A-3a ) .
Although a 3-acre zoning designation is being requested, the
applicant only intends to subdivide the property into two lots of
5 acres and 4 . 6 acres . According to the Planning Department, the
change, of zone •and ultimate subdivision of the property is to allow
the applicant 's aunt to transfer ownership of a portion of the
property to the applicant . The applicant is a full-time farmer and
currently cultivates ginger on approximately 1 .5 acres of the
property .
The General Plan designates the property as Orchards . The State Land
Use district classification is Agricultural .
The Department of Agriculture states that "The applicant ' s proposal
appears to meet the requirement of Section 205-2 of the Hawaii
Revised Statutes which states that dwelling units constructed on the
proposed lots must be accessory to an agricultural activity. "
The Department of Public Works and Department of Water Supply do not
have any objections to the change of zone request .

of Bill No. 346 and recommends that it pass first reading.
