Your Committee on Planning, to which was referred Bill No. 338 ,
regarding. the rezoning request of Jay Maxner , Kiolakaa-Keaa
Homesteads, Kau, TMK: 9-4-05 : 3, reports as follows :
Bill 33. 8 amends Section 25-109 , Article 3 , Chapter 25 of the
Hawaii County Code , by changing the district classification of
approximately 32. 46 acres of land from Agricultural 20-acre (A-20a )
to Agricultural 10-acre (A-10a ) .
The applicant plans to subdivide the property into three 10-acre
sized lots . The property had previously been used for grazing.
Approximately 3 acres are presently being planted with citrus trees .
Some coffee, papaya, avocado and macadamia nut trees were recently
planted. There are also a greenhouse and a garage/workshop building
on the property .
The Department of Agriculture stated in part, "The applicant ' s - -
proposed use of the site would appear to be a more intensive use of
this marginal agricultural land and in accord with other existing
uses of these soils . We also note that the owners have begun
clearing the land and establishing the agricultural uses . It does
appear that there may be some water problems which will require
careful management . From an agricultural standpoint, it does not
appear that the proposed subdivision would be detrimental since the
lots should be of a sufficient size for viable agricultural
operations . "
The Department of Water Supply stated, "Please be informed that the
existing water system facilities in the area is inadequate to
accommodate the proposed subdivision. "
The Planning Commission, in its letter to the Council Chairman dated
February 19 , 1987 and identified as Communication No . 976 , stated,
"With regard to the question of water , it is determined that the
current rainfall in the area is sufficient to accommodate the
proposed agricultural lots. To accommodate the agricultural
activities on the property, the petitioners have constructed an
8 ,500 gallon water storage tank and another tank of similar capacity
is being constructed . A third 5 ,000 gallon tank is planned. "

Chairman Domingo informed the Committee that a concern he has is that
while the rezoning application involves the waiving of water
requirements , the bill does not include any statement as to how water
is going to be provided. Chairman Domingo recommended that Bill 338
be recommitted to the Planning Committee for further discussion and
that the Planning Department be requested to draft a water waiver
statement for Bill 338 .
Your Committee on Planning recommends that Bill 338 pass first
reading and be recommitted to the Planning Committee for further
discussion.
