Your Committee on Planning, to which was referred Bill No . 328 ,
regarding the rezoning request of Douglass Johnson, Analipo Place ,
South Kona, TMK: 8-1-12: 55 , reports as follows :
Bill 328 amends Section 25-88, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 12, 233 square feet of land from Multiple Residential -
1 ,500 square foot (RM-1® 5) to Village Commercial - 10 ,000 square foot
(CV-10 ) .
In May 1979 , a Planned Development Permit (PDP) was issued to the
previous owner to construct a 16 unit condominium project . A
variance was also requested at that time to allow the construction of
the building at a height of three stories in lieu of the then maximum
height limit of two stories . The variance request was denied.
After the variance was denied , the previous owner applied for a
change of zone from a CV-10 to an RM-1.5 zoned district. The request
was approved by the County Council in July 1980 .
The applicant is now requesting that the subject property be rezoned
to its original CV-10 zoning designation .
The applicant does not have any definite building plans for the
subject property . However , performance conditions are being imposed
by the Planning Commission .
The General Plan designates the property for Medium Density Urban
Development . Such a designation may include Village Commercial
uses . The Kona Regional Plan suggests a Village Commercial zoning
for the property .
Water and other essential utilities and services are available to the
property .
