HomeMy WebLinkAboutREP PC 194 01/27/1987 1984-1988 411, REPORT OF THE COMMITTEE ON PLANNING DATE: January 27 , 1987 Re: Comm. 843 PLACE: Councilroom TIME: 1 : 30 p.m. Chairman and Members • Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 296, regarding the rezoning request of AHIMSA Associates , Kohala Estates Subdivision, Kahua, North Kohala, Hawaii , TMK: 5-9-07 : 5, reports as follows : Bill No. 296 amends Section 25-95A, Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of approximately 27 .22 acres of land from Agricultural 20-acre (A-20a) to Agricultural 3-acre (A-3a) . The subject property is located within the Kohala Estates Subdivision. The bill passed first reading of the County Council on January 20 , 1987 , and was recommitted to the Committee on Planning at the request of committee chairman Takashi Domingo. This action was taken to enable Mr . & Mrs . Emilio Olcese to testify before the Committee and to explain why they are suggesting that AHIMSA' s rezoning request should not be approved. The Olceses had earlier written to the Planning Commission and Council to request that the application be denied. Your Committee heard testimony from Mr . Olcese to the effect that the Olcese family lost a considerable sum of money while AHIMSA Associates benefitted in various transactions involving the subject property. Mr . Olcese offered to present to the Committee documents involving past transactions ; however, Councilman De Luz informed Mr . Olcese that his is a legal problem and that the Planning Committee is not the appropriate body to hear his concerns . Your Committee called on Norman Hayashi of the Planning Department, and Corporation Counsel Ronald Ibarra to respond to and clarify some of Mr . Olcese ' s statements. Mr . Hayashi stated that he is not familiar with Mr. Olcese ' s complaints . Mr. Ibarra stated that Councilman De Luz correctly pointed out that the issues before the committee involve rezoning and whether or not the request conforms to the General Plan . Mr . Ibarra added that he heard Mr . Olcese state earlier that his family no' longer has ownership interest in the subject property and that if this case has already been litigated in court, as stated by Mr. Olcese, the subject matter should not be raised repeatedly. Corporation Counsel and the Planning Department were asked to research Mr. Olcese ' s concerns , in the interim. Councilwoman Lai informed Mr. Olcese that the application is being forwarded to the County Council for final approval and that the action the Council takes will depend on the findings of the Corporation Counsel and Planning Department . Your Committee on Planning is now in full accord with the intent and purpose of Bill 296 and recommends that it pass second and final reading unless advice to the contrary is received from either or both the Corporation Counsel and Planning Department . threong..."...
