Your Committee on Planning, to which was referred Bill No. 304,
regarding the rezoning request of Christopher Norrie, Kaawaloa,
South Kona, TMK: 8-1-09:Portion of 2 & 14, reports as follows :
Bill 304 amends Section 25-88, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
approximately 14.45 acres of land from Agricultural 5-acre (A-5a) to
Agricultural 2-acre (A-2a) .
The Committee amended the bill to include revisions requested by the
applicant and agreed to by the Planning Department and
Corporation Counsel .
Bill No. 304, Draft 2, passed first reading of the County Council on
January 20 , 1987 , and was recommitted to the Committee on Planning,
as requested by the committee, for further review and action. This
action was taken at the request of a representative of the
Planning Department who was present at the committee meeting. He
recommended that approval of Bill 304, Draft 2, be deferred to allow
the Planning Director time to more closely review the amended bill .
In a memo to the County Council dated January 19 , 1987 , the
Planning Director identified two areas of concern. (The memo is
identified as Communication No. 893.1 . ) The concerns are:
1 . The conditions and restrictive covenants contained
in the original bill were developed in close
cooperation with surrounding property owners .
They may not have had an opportunity to review the
amended conditions. They should be given this
opportunity. The Planning Director suggested that
this may be done by remanding the rezoning back to
the Planning Commission or the applicant may
obtain notorized statement of concurrence from
surrounding property owners .
2. The deletion of the phrase "no horse farm" from
Section 2. C. ( 2) of Bill 304, Draft 2. The
Planning Director suggested that the following

statement be added at the end of Section 2.B:
"Although nothing contained herein shall prevent
the keeping of horses for personal use,
horsebreeding, in and of itself , shall not be
considered a substantial agricultural activity for
the purposes of complying with the requirements of
the subject condition. "
In reference to concern No. 1, Mr. Domingo informed the committee
that Mr . Norrie had given him a memo signed by Dexter Smith and
George Schattauer , stating that they are aware of and in agreement
with the proposed amendments to the bill.
In reference to concern No. 2, your Committee on Planning agrees with
the Planning Director and, as such, has amended Draft 2 of Bill 304
to include the suggested statement .
Your Committee on Planning is in accord with the intent and purpose
of Bill 304, Draft 3 , and recommends that it pass second and final
reading.
